professional regulator An independent self-regulatory association or statutory body (sometimes a registered corporation) that is responsible for overseeing the education, registration, and practice requirements of members of a given profession. For example, the General Medical Council sets admission and practice standards for those wishing to qualify in and practise medicine in the UK; registration with the Council entitles a registrant to use the protected titles “general practitioner”, “surgeon”, or “physician”. The main aim of the regulator is to protect the interests of those served by the profession, in this case patients and other health service users. As the association or body responsible for ensuring that registrants adhere to the agreed standards of conduct and practice, the regulator may investigate alleged misconduct or breaches of the profession’s code. Where a registrant’s fitness to practise is called into question, or their performance is judged to have fallen below the expected standard or is in breach of the profession’s code, the regulator may issue a warning, impose restrictions, or commence disciplinary proceedings. To prosecute a registrant for having committed a regulatory or disciplinary offence, or a breach of the profession’s code, a regulator must present its case at trial, doing so before its associated tribunal or adjudicatory function (see professional tribunal). The regulator for solicitors is the Solicitors Regulation Authority, an arm of the Law Society. |
