power n. A legal discretion (as opposed to a duty) to carry out or refrain from carrying out any act. When powers affect the rights of others (e.g. the powers of trustees and administrative powers), their exercise can be challenged in the courts. An act that goes beyond the scope of a power as specified in the instrument creating it (e.g. a trust deed or statute) is invalid; so, too, is any act carried out in abuse of a power (e.g. when it is exercised after taking irrelevant considerations into account, for improper motives, or capriciously).
