tracing trust property The right of a beneficiary under a fiduciary relationship to recover trust property or its value if it is wrongfully disposed of by the fiduciary. The right exists against anyone except a person who has purchased the trust property without notice of the fiduciary obligation; a beneficiary may, for example, recover the property from a trustee who has mixed trust property with his own funds, or from a person to whom the property has wrongly been given. |
