agent provocateur A person who actively entices, encourages, or persuades another person to commit a crime that would not otherwise have been committed and then reports the person to the authorities. The agent provocateur may be regarded as an accomplice in any offence committed as a result of this intervention; however, the fact that the principal was enticed, encouraged, or persuaded by the agent provocateur provides no defence for the principal. At the same time, evidence of entrapment by undercover agents of the state has sometimes led the court to exclude certain evidence or to stay proceedings as an abuse of process. |
