easement of necessity An easement that is implied into a transfer of land because the land would be completely unusable without it. The most common example is the case of a “landlocked close”—a piece of land that has no access from the highway. An easement of necessity may be implied in favour of the person disposing of the land (implied reservation) or in favour of the person receiving the land (implied grant). |
