单词 solicitor
释义

solicitor
n. A legal practitioner admitted to practise under the provisions of the Solicitors Act 1974. Solicitors form much the larger part of the English legal profession (compare barrister), often undertaking the general aspects of giving legal advice and conducting legal proceedings. They have rights of audience in the lower courts but may not act as advocates in the Senior Courts (except in chambers) or the Supreme Court unless they have acquired a relevant advocacy qualification under the terms of the Courts and Legal Services Act 1990. A solicitor may be sued for professional negligence and owes the duties of a fiduciary to his or her client; these include the duty to preserve the confidentiality of the client’s affairs. Practising solicitors must possess a practising certificate.

To qualify, solicitors must be educated to degree level or equivalent and take a one-year legal practice course (LPC), followed by two years as an employee under a training contract (previously called articles of clerkship). Those whose degree was in a subject other than law must spend at least one further year at a university undertaking a graduate diploma in law (GDL) before undertaking the legal practice course. From September 2021, the Solicitors Regulation Authority will introduce a new mode of qualifying as a solicitor. After taking their degree, all candidates will have to pass a new independent assessment, the Solicitors Qualifying Examination (SQE), which will replace both the GDL and the LPC. The current requirement to work as an employee under a training contract will be replaced with a requirement to complete at least two years of qualifying legal work experience.
