| 释义 | 最後一次付款 In relation to a building contract, payment by a proprietor to the contractor of any part of the agreed price outstanding upon final completion of the work. The amount of final payment is normally determined by the contract administrator in the final certificate which is issued at the end of the defects liability period. Normally, final payment is calculated as being the total amount due under the contract (being the original contract sum subject to adjustments for variations, omitted works, liquidated damages, etc) less progress, installments or interim payments. The assessment of the final payment should also have regard to all claims between the parties. Standard form building contracts may provide for the requirements for and the consequence of final payment. In some cases, the provisions may provide that once the final account and final statement have been agreed upon, the contractor is discharged from further obligations: London Borough of Barking & Dagenham v Terrapin Construction Ltd [2000] 9 BLR 479, 74 Con LR 100 (CA).
