presumption of death An originally common-law presumption that someone has died, now contained in the Presumption of Death Act 2013. On an application under the Act by a sufficiently interested person, a court must make a declaration of presumed death if it is satisfied that a person is thought to have died, or for at least seven years has not been known to be alive. Such a declaration under the Act will inter alia bring the relevant person’s marriage or civil partnership to an end. |
