provisional damages
Damages given in personal injury cases when the injuries sustained may cause in the future some serious disease or other serious deterioration in the claimant’s physical or mental condition. Under the Supreme Court Act 1981 s 32A the court has the power to make an immediate award of damages on the basis of the claimant’s present condition and to order that he can come back within a specified time for a further award if the disease or condition develops. |
