The principle that a media defendant will not be compelled in a defamation action (either at the interlocutory stage or at the trial) to disclose its sources of information unless it is necessary to do justice between the parties: British Steel Corp v Granda Television Ltd [1981] AC 1096. It applied not only to newspapers but to the news media. The overriding jurisdiction for the rule was the public interests in the free flow of information: British Steel Corp v Granada Television Ltd, supra. For example, the court may not order the publisher of a magazine sued for libel to disclose the author and editors of the allegedly libellous article concerned: Sham John v Eastweek Publisher Ltd [1994] 1 HKC 264 (CA).
