释义 | 不勝任 In relation to employment, the inability to do the work contracted for that results from an employee’s lacking (or failing to exercise) the skills necessary for the job. An employee who accepts a job implied warrants that he or she possesses and will exercise the necessary skills with reasonable care: Mingson Industries Ltd v Lin Shun Hung (HCA 6566/90, unreported). An employee who fails to comply with the implied warrants may, where the breach is fundamental, be liable to be summarily dismissed: Dr Tsoi Wing Sang v Secretary for the Civil Service (HCAL 1611/2000, unreported).
