Incorrect, deviate from the norm, markedly different. It usually refers to a decision, of a judge, of a tribunal, council or board. If a decision is found to be aberrant, it will be set aside. A decision will have the appearance of being aberrant if it is markedly out of line with decisions which the decision-maker regularly makes on the topic: Pearl Securities Ltd v Stock Exchange of Hong Kong Ltd [1999] 1 HKC 448. An appellate court ought not to interfere with the discretion of a trial judge unless his decision is aberrant. The correct test to adopt in deciding whether to interfere with the exercise of a discretion by a judge is whether or not a reasonable judge regardful of his duty to act judicially could have reached such decision: Hadmor Productions Ltd v Hamilton [1983] 1 AC 191; PCCW-HKT International Ltd v New World Telephone Ltd [2001] 2 HKC 416 (CA).
