製造 To make or produce a thing which is different from that out of which it is made: McNicol v Pinch [1906] 2 KB 352; Gamble v Jordan [1913] 3 KB 149. To manufacture may also include every kind of preparation, mixing and treatment except packing and unpacking: Dutiable Commodities Ordinance (Cap 109) s 2(1). Manufacture does not include mere packing: The Queen v Wingkason Brothers Co Ltd [1990] 2 HKLR 19 (CA).
Intellectual property - All grants of patents may be made in accordance with the developed principle of patent law. It is necessary to involve a contribution to the practice of the ‘useful arts’, as distinct from the fine arts and susceptible of industrial application: Patents Ordinance (Cap 514) s 93. It excludes human beings and the biological processes for their generation, food products comprising mere mixtures of known ingredients, and inventions the use of which would be contrary to law.
