释义 | 租購 A device used in order to give possession and the use of the goods to an intending buyer over a period during which he pays the price, with interest, by instalments while the seller retains the title of the goods as security for the unpaid balance of the price: McEntire v Crossley Bros Ltd [1895] AC 457 (HL). In normal agreement, there must be a bailment or hiring of the use of goods for the payment of rent and interest, with an option given to the hirer to purchase the goods: Helby v Matthews [1895] AC 471 [1895-99] All ER Rep 259 (HL). Ownership remains vested in the lender until the hirer makes the final payment, however, in certain circumstances, the person who keeps, uses or is in possession of the property deems to be the owner: for example, Road Traffic Ordinance (Cap 374) s 2; Motor Vehicles Insurance (Third Party Risks) Ordinance (Cap 272) s 2. 准予預計的買方在一段期間內有權管有及可使用有關貨品的方法,在這期間內,預計的買方分期支付有關的貨價和利息,而賣方則保留貨品的所有權作為對未付餘款的抵押:McEntire v Crossley Bros.
