释义 | 取代的裁決 A verdict to replace the verdict upon which the appellant was convicted after a successful appeal against conviction. Where the prosecution accepts that the jury’s verdict must be set aside but contend that, on the correct factual basis, the court should substitute a different verdict of guilty, the onus of satisfying the court that it should do so must rest on the prosecution: Smith v Her Majesty’s Advocate (2001) SCCR 143. In a case of an appeal against conviction where the jury could have found the appellant guilty of some other offence and, on the finding of the jury, it appears to the court that the jury must have been satisfied of facts which proved him guilty of the other offence, the court may, instead of allowing or dismissing the appeal, substitute for the verdict of the jury a verdict of guilty of the other offence and pass such sentence in substitution for the sentence passed at the trial as may be authorised by law for the other offence, not being a sentence of greater severity: Criminal Procedure Ordinance (Cap 221) s 83A(1), (2). In certain circumstances a verdict of not guilty by reason of insanity may be substituted and the appellant ordered to be admitted to a mental hospital: s 83D(1).
