释义 | 非符合用途 The lawful use of a building or parcel of land for some purpose in conflict with the current zoning plan. It is the common practice for plans made under the Town Planning Ordinance (Cap 131) to provide for the continuation of existing uses which are not in conformity with such plans. It is also common for the notes of a plan to state that no action is required to make the use of any existing land or building conform to the plan. However, the use must be actually being made of the land when the plan is introduced: Halsbury’s Laws of Hong Kong, Vol 25, Town Planning [385.181]. Although non-conforming existing uses are tolerated, redevelopment and new development proposals must conform to the zoning of the plan: ibid [385.180].
