A duty which cannot be passed on or delegated to another and so relieve the delegator of responsibility or liability. A hospital’s duty of care to its patients is an example of a non-delegable duty: Cassidy v Ministry of Health [1951] 1 All ER 574. As a general rule, a person subjected to a statutory duty cannot escape liability on the ground that he had delegated the duty to another. Thus where the statute imposes a personal duty on an employer to perform an act or to secure that the act is performed, the employer cannot delegate his duty to an employee or other person so as to relieve himself from liability to a third person for injury suffered through such failure to perform the duty: Halsbury’s Laws of Hong Kong, Vol 25, Tort [380.186]; A-G v Shun Shing Construction Engineering Co Ltd [1986] HKLR 311.
