释义 | 不得強制法官 A rule of public policy which prohibits compelling judges from giving evidence concerning cases tried by them: Ramlochan v R [1956] AC 475, 2 All ER 577n (PC). The rule derives from the need to ensure the dignity of the office conferred upon superior court judges: R v Gazard (1838) 8 Car & P 595, 173 ER 633. Inferior judges and court officers may be compelled to give such evidence, however, if a situation arises where their evidence is vital, they should be able to be relied on and not allow the fact that he is not compellable to stand in the way of his giving evidence: Warren v Warren [1997] QB 488. In relation to any matter not related to a judicial function, judges are in the same position as any other civilian witness.
