| 释义 | 臨時贍養費 1.Maintenance paid by a party to a marriage to the other party, pending a further order of a court. The maintenance may be for either the other party or a child. It is ordered when the party or the child is in immediate need of financial assistance. As for financial provision for the child of the family, such order may be made before or on granting the decree of divorce, nullity of marriage or judicial separation: Matrimonial Proceedings and Property Ordinance (Cap 192) s 5. It can be a lump sum or a periodic payment. 2. The grant of interim maintenance was within the discretion of the court: Ye Hong Ying v Chan Lup Ying [1996] 3 HKC 426 (HC). In an application for interim maintenance, it is not appropriate to take a long term view or to make a detailed investigation of the financial position of the parties, the court is only required to fix a reasonable figure, having regard to the needs of the wife and children and the ability of the party to pay: Wong Che Wai Raymond v Wong Chung Yee Fung Helen & Anor [1983] 1 HKC 556 (HC).
