| 释义 | 預約保險單 An agreement under which the insurer agrees to accept liability for any declarations made by the insured within the terms and conditions of the agreement: Citadel Insurance Co v Atlantic Union Insurance Co [1982] 2 Lloyd’s Rep 543. The agreement may be for a specified period or ‘always open’, subject to a cancellation clause, which allows either party to terminate the agreement by giving prior notice to the other party. The insurer will issue a certificate of insurance in accordance with the details of declaration made in pursuance to the open cover. There will be no contract of insurance, if the declaration is made not in compliance with the terms and conditions of the open cover: The ‘Tiburon’ [1990] 2 Lloyd’s Rep 418. The terms of an open cover for cargo insurance include ports covered and/or excluded, maximum value of cargoes carried in one shipment and nature of cargo, etc. A valuation clause may also be inserted to avoid disputes over the value of cargoes. An open cover is beneficial to both the insured and the insurer. The insured is not required to apply for insurance for each of the shipments, while the insurer can ensure a continuous flow of premium income.
