释义 | 賄款或賄物 A gift to a person as an inducement to that person to breach a duty owed to a third party: A-G of Hong Kong v Reid & Ors [1994] 1 AC 324, 1 All ER 1 (PC). In civil law, a bribe means the payment of a secret commission to the agent of another: Industries & General Mortgage Co Ltd v Lewis [1949] 2 All ER 573. When a bribe is offered and accepted in money or in kind, the money or property constituting the bribe belongs in law to the recipient: A-G of Hong Kong v Reid, supra. However, he or she must pay and account for the bribe to the person to whom the duty was owed: A-G of Hong Kong v Reid & Ors, supra.
