The questioning by police officers of a person in connection with investigating the commission or possible commission of an offence. It usually consists of a police officer or officers asking a suspect questions when he or she has been taken into custody. There are various rules in place to ensure that a police officer observes the correct conduct during this time. For example, a suspect must be delivered directly to the officer in charge of a police station after he or she has been taken into custody and a police interview must not take place before this: Police Force Ordinance (Cap 232) s 51. However, this requirement is not always followed if it is more important for the detection or prevention of a crime to conduct a police interview in a different way: Yeung Ka Yee v HKSAR (FAMC 16/2003, unreported). Police interviews should be conducted in compliance with the Rules and Directions for the Questioning of Suspects and the Taking of Statements made by the Secretary for Security in Hong Kong.
