Police notebook |
A notebook issued to police officers to record particulars of incidents, details of interrogations (except when a formal record of interview or typed statement is taken), witness addresses, offender details, and other matters of special interest. Police officers can record cautions and signed statements in their notebooks: R v Chan Chi Fai & Anor [1995] 1 HKC 58. Police notebooks are usually destroyed after three years so that they cannot be used as evidence for the basis of a claim, particularly in immigration cases: Ng Siu Tung & Ors v The Director Of Immigration (FACV 1/2001, unreported). A police officer should record the exact words used by a suspect or a witness who is identifying or describing a suspect. Information that exonerates or tends to exonerate a suspect should also be recorded. Ng Siu Tung & Ors v The Director Of Immigration(終院民事上訴2001年第1號,未經彙報)。 |
