Dedication |
1. An act by a legally competent person making available land for the purposes of passage and repassage by the public. A dedication may be expressed by words or inferred from conduct: Spedding v Fitzpatrick (1888) 38 Ch D 410 (CA). Mere use by members of the public is insufficient; there must be an intention to dedicate and an acceptance of that dedication: Simpson v A-G [1904] AC 476. The intention and the acceptance are questions of law. In Hong Kong, dedication to the government is usually made by deed. 2. The statutory dedication or acquisition of land for public use: Government Rights (Re-entry and Vesting Remedies) Ordinance (Cap 126). 1. n. |
