释义 | 估值師 In real property law, a person who, in any capacity, holds himself or herself out as ready to make a valuation of land. A fair price is to be fixed by a valuer, the valuer’s decision is final unless fraud or collusion can be proved, or incorrect or incomplete reasons or calculations are stated by the valuer: Baber v Kenwood Manufacturing Co Ltd and Whinney Murray & Co [1978] 1 Lloyd’s Rep 175 (CA). In rent review, the rent review clauses normally require the valuer to assess the rent on the basis of a letting in the open market by a willing landlord to a willing tenant. A valuer owes a duty of care and may be liable in negligence: Arenson v Casson Beckman Rutley & Co [1977] AC 405, [1975] 3 All ER 901 (HL). Where a valuation report is prepared by a valuer for a mortgagee, the valuer may also owe a duty of care to the purchaser: Yianni v Edwin Evans & Sons [1982] QB 438, [1981] 3 All ER 592.
