| 释义 | 放棄侵權行為 An election by a plaintiff, in circumstances where the defendant has committed a tort, to sue in restitution and recover as restitution the gain made by the defendant in committing the tort: United Australia Ltd v Barclays Bank Ltd [1940] 4 All ER 20, [1941] AC 1 (HL). By so electing, the plaintiff waives the right to sue in tort. If a person’s goods have been converted or detained and are sold by the wrongdoer, the owner may waive the tort and sue for money had and received, but if he does so and recovers under judgment, he may not subsequently sue in conversion: Verschures Creameries v Hull and Netherlands SS Co Ltd [1921] 2 KB 608 (CA). Trespass, conversion, and passing off are the torts most commonly waived.
