释义 | 一年零一日規則 The rule that, for the purposes of offences involving death and of suicide, an act or omission is conclusively presumed not to have caused a person's death if more than a year and a day elapsed before he died: Offences against the Person Ordinance (Cap 212) s 3 (repealed). The period includes the day on which the act which caused the death occurred: Turner Kenny’s Outlines of Criminal Law (19th Ed, 1966) p 84. This rule has been abrogated for all purposes by statute. However, the abrogation does not affect the continued application of the rule to a case where the act or omission (or the last of the acts or omissions) which caused the death occurred before the commencement of the Statute Law (Miscellaneous Provisions) Ordinance 2000 (32 of 2000): s 3(2).
