Ownership rights over property as recognised by a legal system. Title to land has historically been based upon possession. If there was a dispute over the ownership of land the court would decide in favour of the person who could show he had the better (ie earlier) right to possession: Nield Hong Kong Land Law (2nd Ed, Longman) ch 7 p 157. Title to property can be acquired in many ways, and does not necessarily depend on the possession of documents: for example Halkett v Earl of Dudley [1907] 1 Ch 590. The law recognises possessory title, which is a title gained in Hong Kong by the operation of the Limitation Ordinance (Cap 347). Title can also be acquired more formally, for example by conveyance, by disposition in a will or by operation of law: Halsbury’s Laws of Hong Kong, Vol 16, 2001 Reissue, Land [230.0237].
