A lease provision requiring maintenance of the structural parts of the premises and proper care of the premises during the term of the lease. Unless expressly provided there is no obligation upon a lessor to repair the premises: Cavalier v Pope [1906] AC 428. Exceptions to this are for oral weekly tenancies, and furnished residential premises (which are to be fit for use upon commencement): Mint v Good [1950] 2 All ER 1159, [1951] 1 KB 517; Smith v Marrable (1843) 11 M & W 5, 152 ER 693. There is, subject to any express contrary provision, an implied contractual obligation on the lessee. The extent of this obligation will be determined by the particular matrix of circumstances surrounding the lease: Warren v Keen [1953] 2 All ER 1118, [1954] 1 QB 15. But it will normally include keeping the premises wind and water tight, and making fair and tenantable repairs: Wedd v Porter [1916-17] All ER Rep 803, [1916] 2 KB 91; Cheetham v Hampson (1791) 4 TR 318, 100 ER 1041. It will not usually extend to rebuilding (Torrens v Walker [1904-7] All ER Rep 800, [1906] 2 Ch 166), updating the premises (Saner v Bilton (1878) 7 Ch D 815), or correcting wear and tear (Jeffery v Buckland (1873) 4 AJR 163; Regis Property Co Ltd v Dudley [1958] 3 All ER 491, [1959] AC 370 (HL)). Repairs can be required notwithstanding that they are necessitated by an inherent defect and there is no obligation eradicate the cause: Ravenseft Properties Ltd v Davstone (Holdings) Ltd [1979] 1 All ER 929, [1980] QB 12.
