The liability must be enforceable by law: Smit Tak Offshore Services & Ors v Youell & General Accident Fire & Life Assurance Corp plc [1992] 1 Lloyd’s Rep 154 (CA). A liability insurance policy normally covers the risks of legal liability and may include liability to pay damages for breach of contract, tort, or some other form of compensation, restitution or reimbursement. Certain forms of liability insurance, such as employees’ compensation and third party liability motor vehicle insurance, are compulsory: Employees’ Compensation Ordinance (Cap 282); Motor Vehicles Insurance (Third Party Risks) Ordinance (Cap 272) s 4.
