Defamatory statement made or conveyed by written or printed words or in some other permanent form, for example, photograph for casting used in a film: Li Yau Wai, Eric v Genesis Films Ltd [1987] HKLR 711 (HC), published of and concerning the plaintiff, to a person other than the plaintiff. The term ‘words’ includes pictures, visual images, gestures and other methods of signifying meaning: Defamation Ordinance (Cap 21) s 2. An actionable libel can in certain circumstances be dealt with by criminal proceedings. It is not necessary to allege or prove special damage in an action for libel, and the law presumes that some damage will flow in the ordinary course of events from the mere invasion of his right to his reputation, and such damage is known as general damage: Halsbury’s Laws of Hong Kong, Vol 25, Tort [380.507], [380.508], [380.513].
