| 释义 | 不便的合併 One of the bases for an improper joinder. Where it is inconvenient for the rights and liabilities of parties to be jointly determined, the court has discretion not to permit a joinder: Bendir & Ors v Anson [1936] 3 All ER 326 (CA); Idmiston Ltd v Asian Master Enterprises Ltd & Anor [1988] HKC 588 (HC). If a person has been improperly or unnecessarily made a party to an action, he may apply by interlocutory application to cease to be a party: The Rules of the High Court (Cap 4A) O 15 r 6. A court may order separate trials or another appropriate order in circumstances where any joinder of parties or causes of action may embarrass or delay the trial or is otherwise inconvenient: O 15 r 5. The joinder of the appellants in one trial does not make the trial a nullity: HKSAR v Cheng Kan & Ors [1998] 2 HKC 709 (CFI).
