| 释义 | 見證 Generally, to give evidence or witness. To witness by signature the execution of a deed or document: Wickham v Marquis of Bath (1865) LR 1 Eq 17. Documents that require attesting include wills. It is not necessary to adduce the evidence of an attesting witness to a document to prove that a document was signed or attested as it purports to have been signed or attested: Evidence Ordinance (Cap 8) ss 18, 42. Deeds - At common law, no attestation is required to prove due execution: Champhon Industrial Ltd v High Projects Industrial Ltd (HCMP 3631/92, unreported). There is a rule of practice in Hong Kong that a conveyancing document must be attested and such attestation by the solicitor present at the signing of the document is strongly recommended by the Law Society of Hong Kong: Law Society Circular, No 81 of 1985. If it is impracticable for the solicitor to be present, a clerk may attest the documents which are not, by law, required to be attested by a solicitor; and the attestation has to be verified by the solicitor: Law Society’s Practice Direction 1990. Succession - To be valid, a will should be signed by the testator in the presence of at least two witnesses who should then attest and subscribe the will in the presence of the testator: Wills Ordinance (Cap 30) s 5(1). Gifts to attesting witnesses and their spouses are void: s 10.
