A state of conjecture or surmise where proof is lacking and ordinarily arises at or near the outset of an investigation: Hussein v Chong Fook Kam [1970] AC 942, sub nom Shaaban bin Hussein v Chong Fook Kam [1969] 3 All ER 1626 (PC); The Queen & Cheng Chun-Wo [1989] 1 HKLR 600. Suspicion need not be based on admissible evidence: Dumbell v Roberts [1944] 1 All ER 326 (CA). There must be reasonable grounds for a suspicion before an arrest is made by a police officer without a warrant: Police Force Ordinance (Cap 232) s 50(1)(a). The determination of whether reasonable grounds exist for the suspicion is an objective test and the fact that an officer may have an honest belief in facts which would justify an arrest does not inevitably mean that the belief is reasonable: R v Hung Hing-tong [1985] 1 HKC 172.
