A minimal obligation undertaken as consideration to support a promise. In contract law, a purely nominal consideration will suffice to make a promise binding: Thomas v Thomas (1842) 2 QB 851, 114 ER 330. A merely nominal consideration does not prevent a contract or settlement from being regarded as voluntary so far as third persons are concerned: Kelson v Kelson (1853) 10 Hare 385. Valuable consideration does not include nominal consideration in money: Powers of Attorney Ordinance (Cap 31) s 5(6). See also Adequacy of consideration; Consideration; Contract.
