释义 | 但書 Lat – provided. 1. A form of words beginning ‘Provided that…’ which is added at the end of a section to limit the operation of the section by adding exceptions. A stipulation which cuts down upon the effect of the main operative part of the instrument which precedes it: Halsbury’s Laws of Hong Kong, Vol 17, Landlord and Tenant [235.099]. 2. The power of an appellate court, for example, the Court of Appeal, to dismiss an appeal against conviction notwithstanding that it has found that there has been an error or defect in the trial of the appellant: Criminal Procedure Ordinance (Cap 221) s 83(1) proviso; Chan Chuen Ho v HKSAR [1999] 1 HKC 707 (CFA). The proviso allows the appeal to be dismissed where a reasonable jury properly directed would on the evidence have without doubt convinced the appellant: R v Li Wai Keung [1994] 1 HKC 243 (CA); HKSAR v Coady (No 2) [2000] 3 HKC 570 (CA). Another formulation of the general test for when the proviso might be applied is whether, but for the error the subject of appeal, the jury would inevitably have convicted: R v Lam Ming Kwong [1983] 1 HKC 139 (CA); R v Chiang Chui Shun [1985] 2 HKC 377 (CA).
