释义 | 促訟人 A person who brings an action in the name of the Attorney-General (or in Hong Kong, the Secretary for Justice) where the proceedings involve the public interest and the person would otherwise lack the standing to sue: London County Council v A-G (UK) [1902] AC 165. A relator might, for instance, bring an action to compel the performance of a statutory duty: A-G (UK) v Colchester Corp [1955] 2 QB 207. Although he is the nominal plaintiff, the Secretary for Justice is not deemed to be a party to the proceedings, so as to be liable for costs, but the relator is liable for costs: Re Cardwell, A-G v Day [1912] 1 Ch 779. Before the name of any person is used in any action as relator, that person must give a written authorization so to use his name to his solicitor and the authorization must be filed in the Registry: The Rules of the High Court (Cap 4A) O 15 r 11. Any person may act as relator in the proceedings, and the absence of any interest in or injury to the relator affords no answer to them: A-G v Logan [1891] 2 QB 100 (DC).
