A party to a deed that releases the other party (the releasee) from an obligation. At law a right of action arising solely on a deed may be released only by deed. A person releasing his rights is not bound by the release unless at the time when he gave it he was aware of his rights: McCarthy v Decaix (1831) 2 Russ & M 614. Equally, a release will always be construed as limited to the subject matter really intended to be waived: large words will not be taken to apply to matters unknown to the releasor: Ramsden v Hylton (1751) 2 Ves Sen 304.
