释义	近似原則 AF – as nearly. If the trust fails the beneficial interest results to the settlor or testator. If a charitable trust fails, the cy-près doctrine applies, by which the trust property is applied for other charitable purpose which is as near as possible to the original purpose which cannot be carried out. For example, the doctrine may be applied if the precise purpose of the trust is uncertain, has never existed or ceased to exist before the testator’s death or if the purpose or institution ceased to exist after the gift took effect. If the original purpose has been fulfilled and a surplus remains in the charitable trust, cy-près will be applied to the surplus: Re Raine (deceased), Walton v A-G [1956] 1 All ER 355, Ch 417; Re Granville Sharp [1922] HKLR 32. This doctrine can also be stipulated as a guiding principle in charitable matters. For example, it is stipulated that the power of alteration of the conditions of award shall be exercised in accordance with the cy-près rule: Education and Scholarships Fund Ordinance (Cap 1085) s 20.
