| 释义 | 重新公布 Confirmation of an unrevoked testamentary instrument; re-execution of an existing valid will in accordance with the formalities of valid will making, with the effect of confirming the will and causing the will to take effect from the date of republication rather than the date when first executed. There can be no republication without re-execution, because the Wills Ordinance (Cap 30) s 8 stipulates that ‘publication’ of a will is not necessary. The re-execution may take the form of actual re-execution of the will with the necessary formalities, or be effected by means of a codicil: Re Smith, Bilke v Roper (1890) 45 Ch D 632. For a codicil to have the effect of republishing a will it must contain some reference to it, and if it does not there will be no republication (Re Smith, Bilke v Roper, supra); but no precise form of words is necessary (Potter v Potter (1750) 1 Ves Sen 437), and the codicil need not expressly republish the will (Barnes v Crowe (1799) 1 Ves 486). There must be an intention to republish: Dunn v Dunn (1866) LR 1 P & D 277.
