释义 | 正式承認 An admission of fact made by a party at a hearing which relieves the other party of proving in its case the matter admitted. In criminal proceedings in Hong Kong, any fact of which oral evidence may be given in any criminal proceedings may be admitted for the purpose of those proceedings by or on behalf of the prosecutor or the defendant; and the admission by any party of any such fact is, as against that party, to be conclusive evidence in those proceedings of the fact admitted: Criminal Procedure Ordinance (Cap 221) s 65C(1). Admissions for the purposes of a civil action may be made by actual or implied admissions on the pleadings or in answer to interrogatories or in writing or at the trial: The Rules of the High Court (Cap 4A) O 18 r 13, O 27 rr 1-5. A statement of fact in a preliminary act is a formal admission binding on the party making it and can only be departed from with the special court: The Seacombe, The Devonshire [1912] P 21 (CA).
