| 释义 | 與工作有關的死亡 Death that is or may be related to the occupation of the deceased person, or the occupational activities of another person. An employer is liable to pay statutory compensation in the event of personal injury or death being suffered as a result of any accident arising out of and in the course of the employee’s employment: Employees’ Compensation Ordinance (Cap 282) s 5(1). The court has to decide whether the death of the deceased has arisen out of and in the course of the victim’s employment: Chan Kiu v Exclusive Environmental Services Ltd [1988] 1 HKC 671 (DC). An objective test is applied that an ordinary reasonable person would conclude that there has been a causal connection between the deceased’s death and his employment and this is not rebutted by the evidence adduced: Lee Fuh v Ming Hing Construction Co [1991] HKDCLR 105. If the opinions of the expert medical witnesses differ on the question of causation the court should apply common sense to resolve the differences and the standard of the balance of probabilities to the medical expert evidence: Lee Kin-kai v Ocean Trampling Co Ltd [1991] 2 HKLR 232.
