| 释义 | 在妥善維修的情況下交出 The giving up of possession or return of land or premises in a usable condition or good repair by the lessee or user of land. After a lease has terminated, the landlord may bring an action on the covenant to yield up the premises in repair: Halsbury’s Laws of Hong Kong, Vol 17, Landlord and Tenant [235.320]. When the landlord claims for damages arising out of the defendant's failure to yield up the premises in good, clean and tenantable repair according to the agreement, only the cost of putting the premises back into the condition which they were in at the date of letting would be recoverable under the agreement: James S Lee & co (Kowloon) Ltd v Kapok Garments Ltd [1985] 2 HKC 383 (HC). 由土地承租人或使用者在可使用狀況或妥善維修的情況下，放棄管有權或交回土地或處所。在租契終止後，有關業主可就契諾提出訴訟，以交出維修良好的處所：Halsbury’s Laws of Hong Kong, 第17冊, 業主與租客，第[235.320]段。在業主就有關被告人未能以妥善、整潔及可承租維修情況交出處所的情況下，要求提出損害賠償時，僅可根據協議予以追討收復有關處所至分租日期時的狀況的費用：James S Lee & co (Kowloon) Ltd v Kapok Garments Ltd [1985] 2 HKC 383（高等法院）。 |
