释义 | 締約地法 Lat – the law of a place where a contract is made. 1. The law of the place or country where parties have concluded a contract. A contract formally valid under the lex loci contractus and the proper law will be recognised to be valid in the forum. However, there are arguments against the adoption of the lex loci contractus. Parties are sometimes in places fleetingly, as in the transit lounge of an airport, and are therefore unable to relate to the place or are in a convenient position to seek legal advice in order to determine the prescribed formalities at that location: Halsbury’s Laws of Hong Kong, Vol 7, Conflict of Laws [100.047]. 2. The law of the place governing the performance of a contract. This may or may not be the same as the law of the place where the contract was made.
