| 释义 | 警察紀律審裁體 The tribunal before which a police officer is heard if he commits any disciplinary offences. There are different ‘appropriate tribunals’ for an inspector and a junior police officer: Police (Discipline) Regulations (Cap 232A) reg 2. For junior police officers, the appropriate tribunal is a superintendent: reg 4. For inspectors, appropriate tribunal means (a) a single police officer not below the rank of superintendent appointed by the Commissioner or by a senior police officer; (b) a senior police officer; (c) a board appointed by the Commissioner; (d) a board appointed by the Chief Secretary for Administration: reg 16(1). Proceedings in the police disciplinary tribunal are civil in nature and the civil onus and standard of proof apply to such proceedings: A-G v Tsui Kwok Leung [1991] 1 HKLR 40. However, where the charge carries severe penalties for the defaulter, the standard of proof had to be commensurate with the gravity of the charge. If the events giving rise to such a disciplinary charge will also found serious criminal charges, the criminal standard of proof is applicable: Tse Lo Hong v AG [1995] 3 HKC 428(CA).
