| 释义 | 警方扣押 The keeping, by police, of a person under lawful restraint following arrest and before the person is granted police bail or appears before a court. Such a person may be granted bail or must be allowed to be heard before the Magistrates’ Court within 48 hours of being in custody unless the offence is of a serious nature: Police Force Ordinance (Cap 232) s 52 (1). Any person arrested and detained in police custody must be treated with humanity and respect for the inherent dignity of the human person: Hong Kong Bill of Rights Ordinance (Cap 383) s 8. All persons detained in custody must be given the right to consult a legal adviser, the right to speak to friends and family on the phone, consult a list of solicitors from the Law Society, have a solicitor or barrister present during any interview, to communicate with others via post and be allowed to keep a copy of any written statement of interviews that have taken place: Rules and Directions for the Questioning of Suspects and the Taking of Statements Direction 8(a). Such rights need only be observed if they do not cause any obstruction to the administration of justice: Direction 8(b).
