释义 | 警方扣押 The keeping, by police, of a person under lawful restraint following arrest and before the person is granted police bail or appears before a court. Such a person may be granted bail or must be allowed to be heard before the Magistrates’ Court within 48 hours of being in custody unless the offence is of a serious nature: Police Force Ordinance (Cap 232) s 52 (1). Any person arrested and detained in police custody must be treated with humanity and respect for the inherent dignity of the human person: Hong Kong Bill of Rights Ordinance (Cap 383) s 8. All persons detained in custody must be given the right to consult a legal adviser, the right to speak to friends and family on the phone, consult a list of solicitors from the Law Society, have a solicitor or barrister present during any interview, to communicate with others via post and be allowed to keep a copy of any written statement of interviews that have taken place: Rules and Directions for the Questioning of Suspects and the Taking of Statements Direction 8(a). Such rights need only be observed if they do not cause any obstruction to the administration of justice: Direction 8(b). See also Bail; Investigation. 指某人被逮捕後,在警方批予保釋前或在出席法庭席前,由警方在合法約束下作出扣押。除非所涉為嚴重罪行,否則該人必須在扣押後48小時內批予保釋,或在裁判法院席前作出聆:《警隊條例》(第232章)第52(1)條。任何被逮捕或被警方羈押的人應受合於人道及尊重其天賦人格尊嚴之處遇:《香港人權法案條例》(第383章)第8條。被警方羈押的人必須被給予下述的權利:咨詢法律顧問、與朋友或家人在電話上談話,咨詢律師會提供的清單上的律師,由一名律師或大律師在場的情形下與警方會面,與其他人士以郵遞通訊,並應被允許保留他與警方會面時所作的書面陳述的副本:《查問疑犯及錄取口供的規則及指示》8(a)。這些規則只需在不會引起妨礙司法公正的情形下遵守8(b)。另見 Bail; Investigation。 |
