| 释义 | 平衡進口 A brand of goods (ie under a badge of recognition and other intellectual property rights) imported into Hong Kong for resale, which has been legitimately manufactured and marketed abroad, by or with the authority or consent of the owner of the relevant intellectual property rights in that place, with a view to competing with the authorised Hong Kong distributor of the same brand of goods, and imported into Hong Kong without the agreement of that owner or the exclusive licensee in Hong Kong: Pendleton & Lee Intellectual Property: A Guide to the Law in Hong Kong (2001, Butterworths) pp 17-18, 53. Parallel importation usually happens when there is a price difference between the place of exportation and the place of importation: p 53. In order for parallel importation to be actionable in passing off, it is necessary to show some misrepresentation rather than a mere unauthorised import: p 18.
