释义 | Cherry訴Boultbee的規則 The rule that when a legatee, a debtor of the testator, who is already bankrupt at the time of the testator’s death, the executor of the testator’s estate may not claim the right to set-off and retain the legatee’s debt. The executor must prove this debt as an ordinary creditor and receive a dividend on the debt pari passu (with equal step) with the other creditors: Cherry v Boultbee (1839) 4 My & Cr 442, 41 ER 171; Re Peruvian Railway Construction Co [1915] 2 Ch 144, affd [1915] 2 Ch 442 (CA). See also Equitable set-off. 一項規則指明當受遺贈人是立遺囑人的債務人,而在立遺囑人去世前經已破產,則立遺囑人的遺產執行人不能申索債務抵銷的權利,從而保留受遺贈人所欠債項。遺產執行人必須以一般債權人的身份作出債權證明,並與其他債權人同時及同等地收取攤還債款:Cherry v Boultbee (1839) 4 My & Cr 442, 41 ER 171; Re Peruvian Railway Construction Co [1915] 2 Ch 144, affd [1915] 2 Ch 442(英國上訴法院)。另見 Equitable set-off。 |
