| 释义 | 湯林命令 In the event of an out of court settlement between parties in a civil matter, an order by consent to stay proceedings may be made on terms agreed between the parties which are scheduled to the order, which will order that all further proceedings be stayed except for the purpose of carrying the agreed terms into effect, with liberty to apply as to carrying those terms into effect: Practice Note [1927] WN 290 (issued by Tomlin J, hence its name). For a Tomlin order to be made there must be consent to the order, as opposed to consent to the agreement: McCallum v Country Residences Ltd [1965] 2 All ER 264. The court has no right to force its own opinion on the parties as to the content of the terms of the Tomlin order, although it might make suggestions to the parties: Chu Kin-ying v R (CACC 232/81, unreported). The effect of an order to stay proceedings in this form is to stay the action, whilst nevertheless keeping it alive (McCabe v Joynt [1901] 2 IR 115), since the action is still ‘pending’, for the purpose and to the extent necessary to enable any party thereafter to enforce the agreed terms (Dashwood v Dashwood [1927] WN 276). A Tomlin order can go outside the ambit of the original dispute between the parties and not only resolve the dispute giving rise to the action but also to govern some future disputes relating to the same subject matter and between the same parties and their successors: Colliers Jardine Management Ltd v Natural Way Development Ltd [2001] 2 HKC 580 (CA).
