The direct, dominant, operative or efficient cause of loss or damage under insurance law: Boiler Inspection and Insurance Co of Canada v Sherwin-Williams Co of Canada Ltd [1951] AC 319 (PC). It is a fundamental principle of marine insurance that causa proxima non remota spectatur, that means an insurer will only be liable for loss suffered by the insured where the loss was proximately caused by a peril insured against: Marine Insurance Ordinance (Cap 329) s 55(1). For this purpose the word ‘proximate’ means proximate in efficiency, rather than proximate in time: P Samuel & Co Ltd v Dumas [1924] AC 431 (HL). The question whether a peril insured against was the proximate cause of a loss is a question of fact ‘to be determined on commonsense principles’: Yorkshire Dale SS Co Ltd v Minister of War Transport [1942] AC 691, 2 All ER 6 (HL).
